By accessing or using MOTUS ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and MOTUS.
MOTUS is a fitness and nutrition application that provides periodized training programs, intelligent coaching, meal planning, food photo analysis, macro tracking, barcode scanning, and integration with third-party fitness platforms and calendars. The App is designed to help users achieve their fitness and health goals.
MOTUS also operates a Coach Marketplace that connects athletes with independent human coaches who offer subscription-based coaching services through the platform. Coaches are independent contractors, not employees or agents of MOTUS. See Section 10 for the full Coach Marketplace terms.
To use certain features of the App, you must create an account using email, phone number, Google sign-in, or Apple sign-in. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.
MOTUS offers subscription-based access to premium features through two auto-renewing plans:
Both plans are part of the same subscription group ("Motus Pro") and are mutually exclusive. All payments are processed by the platform where you purchase: Apple In-App Purchase on iOS, Google Play Billing on Android, or web billing providers for web purchases. MOTUS does not store full payment card details.
Both Monthly and Annual plans include a 30-day free trial for new users. During the trial period, you have full access to all premium features. Your subscription will automatically convert to a paid subscription at the end of the trial unless cancelled at least 24 hours before the trial ends. No payment is charged during the trial period.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription through your device settings: iOS Settings > Subscriptions, or Google Play > Subscriptions.
When you cancel your subscription, you retain access to premium features until the end of your current billing period. After that period ends, premium features will be locked and you will need to resubscribe to regain access. Meal logging remains accessible regardless of subscription status.
Meal logging (food search, macro diary, and meal entry), basic calorie/macro target display, and account settings are always free and do not require a subscription. No subscription is required to use these features, now or in the future.
Users who created an account before the App Store approval date of the subscription build ("founding members") receive a 6-month free grace period beginning on that approval date. During this period, founding members have full access to all premium features without payment. At the end of the 6-month grace period, the full paywall is enforced and a subscription is required to continue accessing premium features.
Lifetime access may be granted at the sole discretion of MOTUS administration. Lifetime access is non-transferable and may be revoked in cases of abuse or violation of these Terms.
Promotional pricing, coupon codes, and referral credits are subject to their stated terms at the time of use. MOTUS reserves the right to modify or discontinue promotional offers at any time.
Refund requests are handled on a case-by-case basis. Please contact our support team for assistance with refund requests.
We reserve the right to change subscription prices. Any price changes will be communicated to you in advance and will take effect at the start of your next billing cycle.
Independent coaches on the MOTUS platform may offer their own subscription plans to athletes. These plans are separate from Motus Pro and are priced at the coach's discretion. When you subscribe to a coach's plan:

MOTUS is not a medical service and does not provide medical advice. The workout programs, nutrition recommendations, AI coaching, and other content provided through the App — whether human-designed or AI-generated — are for informational purposes only and should not be considered medical advice.
Before starting any exercise program or making significant changes to your diet, you should consult with a qualified healthcare professional, especially if you have any pre-existing health conditions, injuries, or concerns.
You acknowledge that physical exercise involves inherent risks, including the risk of injury or death. You assume full responsibility for any risks, injuries, or damages that may result from your use of the App.
The App integrates with third-party services including Apple HealthKit, Strava, Garmin, and Google Calendar. Your use of these integrations is subject to the terms and privacy policies of those third parties. We are not responsible for the practices of third-party services.
The App also uses third-party services to operate, including Anthropic (AI), Supabase (database and authentication), RevenueCat (subscription management), Stripe (payments), FatSecret and Open Food Facts (food data), Spoonacular (meal plans), Resend (email), and Vercel (hosting). See our Privacy Policy for details on how data is shared with these providers.
Coaches on the MOTUS platform are independent contractors and not employees, partners, agents, or representatives of MOTUS. MOTUS does not control, supervise, or direct the coaching services coaches provide. Any coaching relationship is solely between you and the individual coach.
MOTUS does not independently verify coach credentials, certifications, qualifications, or experience. Coaches are responsible for the accuracy of any credentials or qualifications they represent to athletes. You are responsible for evaluating the suitability of any coach before subscribing to their services.
MOTUS provides the technology platform and payment processing infrastructure that enables coaches to offer subscription services to athletes. MOTUS is not a party to the service relationship between coach and athlete and does not guarantee delivery, quality, or outcomes of any coaching services.
Coaching advice provided by human coaches through the platform is for informational and motivational purposes only and does not constitute medical, dietary, or clinical advice. You should consult a qualified healthcare professional before beginning any exercise program or making significant dietary changes, regardless of whether that program is AI-generated or coach-designed.
Coaches who use the platform to offer services must agree to the MOTUS Coach Terms of Service, available at /coach-terms. The Coach Terms govern coach eligibility, platform fee obligations, payout terms, coach conduct, and the Stripe Connected Account Agreement. Athletes may review the Coach Terms at any time.
Disputes arising from a coaching relationship should first be raised directly with the coach. If resolution is not possible, contact MOTUS support at support@motusfit.app. MOTUS may, at its sole discretion, mediate disputes or suspend a coach's account pending investigation. MOTUS's liability for disputes between athletes and coaches is limited as described in Section 12.
If MOTUS suspends or terminates a coach's account, active athlete subscriptions to that coach's plan will not automatically renew at the next billing cycle and athletes will be notified. MOTUS will not be liable for any loss of coaching services resulting from coach account suspension or termination.
The App and its original content, features, and functionality are owned by MOTUS and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any content you submit to the App, including workout logs, meal logs, food photos, nutrition label photos, feedback, and other user-generated content. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, process, and display such content for the purpose of providing and improving our services.
To the maximum extent permitted by law, MOTUS and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from:
You agree to defend, indemnify, and hold harmless MOTUS and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. AI-GENERATED CONTENT IS PROVIDED WITHOUT WARRANTY OF ACCURACY OR COMPLETENESS.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved in the state or federal courts located in Virginia.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms in the App or by other means. The effective date at the top of this page indicates when the Terms were last revised. Your continued use of the App after changes constitutes acceptance of the modified Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy and, where applicable, the Coach Terms of Service, constitute the entire agreement between you and MOTUS regarding your use of the App and supersede any prior agreements.
